The integration of AI into Restorative Justice (RJ) brings both exciting possibilities and ethical dilemmas. At its core, RJ is deeply human: rooted in empathy, dialogue, and repairing harm. As technology, especially AI, grows more sophisticated, there’s understandable enthusiasm around how it might streamline processes or provide valuable insights. However, at Restorativ, we approach this cautiously, knowing the delicate balance required to ensure technology enhances, rather than detracts from, RJ’s human-centered ethos.

The idea of using AI in RJ is intriguing for several reasons. AI’s ability to analyze vast data sets and identify patterns could allow RJ practitioners to make more informed decisions about conflict resolution. For example, data-driven insights might reveal underlying trends in how certain conflicts escalate or which resolutions tend to have the best outcomes. AI could also help automate mundane tasks like case management, leaving more time for facilitators to focus on the critical human aspects of healing and mediation.

Moreover, there’s potential for AI to aid in creating personalized RJ programs. By examining an individual’s history and social context, AI could offer recommendations tailored to the needs of everyone involved. Virtual mediation platforms, powered by AI, might even expand access to RJ, connecting participants who are geographically distant or unable to attend in person.

Yet, despite the promise AI holds, several ethical concerns arise, and at Restorativ, we are committed to addressing these head-on. One major issue is the risk of bias. AI algorithms learn from data, and if the data reflects systemic biases—such as racial, gender, or socioeconomic disparities—these biases may carry into RJ processes. The human experience of acknowledging harm, taking accountability, and working toward healing is something AI can’t authentically support. Thus, while AI can assist in certain areas, it must never replace the human touch in facilitating RJ.

Privacy is another concern that Restorativ is keenly aware of. As AI tools would likely handle sensitive data—including personal histories and conflict details—questions arise about data security and confidentiality. Ensuring that this information is stored and used responsibly, without compromising the privacy of those involved, is paramount. Misuse or data breaches could erode trust, a critical component of any successful RJ process.
